TERMS & CONDITIONS OF ORDERING
Effective Date: October 18, 2022
1. Terms & Conditions Applicability: Cove Coolout Restaurant and Bar Limited (referred to herein as “The Cove”) grants you permission to access its website in accordance with these Terms & Conditions. These Terms & Conditions shall apply to any order placed online.
2. Order minimum value: The minimum value for orders is J$1,500 (including General Consumption Tax). This is subject to change, without notice.
3. Online Registration: To order online, customers may register to do so by following the step-by-step registration process. Once registered, customers may first login by entering their email address followed by their password. Kindly note that The Cove collects information provided, such as email addresses and phone numbers which may be used to communicate with the customer on advertising and marketing purposes or to contact a customer to verify the quality of service provided. 4. Legal Competence: A customer must be legally competent to register. Any customer who is not legally competent who registers and places any order will not be entitled to returns or refunds. Furthermore, The Cove will not be obliged to complete any order for a customer who is not legally competent.
5. Correct entry of information: Customers are responsible for the correct entry and updating of their information for order completion.
6. Payment options: Accepted payment methods for orders placed through the The Cove’s website include Debit/ Credit Cards. Online payments, are processed via third party payment processing systems, and can only be made by Visa or Mastercard Debit or Credit Cards. This is subject to change.
7. Online Payment: All online payments are subject to acceptance and successful completion through the National Commercial Bank of Jamaica. The Cove accepts no liability for any issues experienced by any customer resulting from the failure of this online payment portal.
8. Product Availability: From time to time some products may not be available for sale and The Cove is under no obligation to fill any order under such circumstances. Special offers, coupons and the like are not automatically applied and must be specifically selected by a customer when placing an order. Where a customer does not take such action, the full price will be charged on a non-refundable basis.
9. Maximum order limit: On a general basis, The Cove limits any single order to 10 items HOWEVER The Cove may further decrease this order limitation on an as-needed basis.
10. Order Acceptance:
a) The Cove is not obligated to accept any order.
b) In addition to (a) above, all orders whether for carry-out are subject to the hours of operation of The Cove. If a customer places an order that cannot be completed within the hours of operation, The Cove may refuse to accept the order.
c) The Cove accepts no liability for the refusal or non-acceptance of any order for any reason.
11. Cancellations or Amendments by Customer: Any order placed and confirmed cannot be cancelled or amended. An order placed for future carry-out may only be cancelled prior to one (1) hour of the carry-out time. Any attempt to cancel or amend an order within one (1) hour of the carry-out time cannot be accommodated.
12. Cancellations by The Cove: Where a situation arises whereby The Cove cannot complete an order for carry-out due to reasons beyond its control, The Cove shall not be liable to complete and shall refund the customer for the order value. In this event, customer is not entitled to any compensation beyond refund in the value of the order.
13. Website Connectivity Issues: The Cove shall not at any time be liable for difficulties and/or interruptions experienced by customers due to website connectivity issues – this shall include delays in order completion.
14. Order satisfaction: If you are not completely satisfied with your experience at The Cove, we will make it right or refund your money. Please consult The Cove’s ‘Refund Policy’. For the avoidance of all doubt – The Cove does not issue cash refunds where the method of payment was not cash.
15. It is a customer’s sole responsibility to educate and familiarize themselves with The Cove’s food offerings and make an informed decision on what they choose to order. The Cove shall accept no responsibility for any food allergy related incidents. Where a customer is in doubt, please consult a representative at The Cove.
16. Amendment to Terms & Conditions: The Cove may amend these Terms & Conditions at any time for any reason.
17. Applicable Laws & Jurisdiction: Jamaica.
18. Severability: Should any provisions of these Terms and Conditions prove to be unenforceable or invalid, the validity of the remaining provisions shall remain unaffected.
19. Disclaimer: If The Cove provides links to other services or entities (such as through advertising on the website), The Cove is not responsible or liable for the content or privacy practices of these services or entities.
20. Trademarks & Copyright:
a) All content included on this site, such as text, graphics, button icons, images and software, is the property of The Cove and is protected by international copyright laws. The content and software on this site may be used as either or both of an informational or shopping resource. Any other use, including the reproduction, modification, distribution, transmission, republication, display or performance of the content on this site is strictly prohibited. The Cove’s graphics, logos and trade names are trademarks of Cove Coolout Restaurant and Bar Limited and they may not be used in connection with any product or service that is not affiliated with this brand that is likely to cause confusion among customers, or in any manner that disparages or discredits The Cove.
b) No person or entity shall use, or cause to be used, any trademark noted on The Cove’s website without the express written consent of the relevant trademark owner. This shall include trademarks related to The Cove’s partners and any paid advertisers.
21. It is a customer’s duty to familiarize themselves with all of The Cove’s policies, including the Refund Policy and the Privacy Policy. All policies are linked and to be read as one.
22. Fraud: The Cove shall not at any time be liable for the fraudulent use of any Credit/Debit Cards by a Third Party to pay for orders on its website. Where a customer believes that their Credit/Debit Cards have been so compromised, this must be reported immediately to the issuing bank.
